The Consumer Product Safety Commission (CPSC) does not regulate upholstered furniture the way it regulates children’s products or electronics — there is no pre-market approval, no mandatory third-party testing for every sofa, and no single “sofa compliance certificate” that covers everything. But that does not mean sofas imported to the United States are unregulated. CPSC jurisdiction covers flammability standards, chemical restrictions, labeling requirements and recall authority that every furniture importer must understand before the first container clears customs. This checklist walks through the CPSC requirements that apply to upholstered sofas sold in the US market, with the documentation you need to have on file before your goods reach the port.
CPSC’s Jurisdiction Over Upholstered Furniture
The CPSC’s authority over furniture comes from three federal statutes. The Flammable Fabrics Act (FFA) gives the CPSC power to set flammability standards for textiles and upholstered furniture. The Federal Hazardous Substances Act (FHSA) covers lead and other toxic substances in surface coatings and substrates. The Consumer Product Safety Improvement Act (CPSIA) adds third-party testing and certification requirements, primarily for children’s products — which includes any sofa marketed for use in a children’s setting.
For standard residential upholstered sofas, the two CPSC requirements that matter most are the 16 CFR Part 1632 cigarette ignition test (for the fabric and foam assembly) and the 16 CFR Part 1640 open-flame standard for mattresses — which applies if the sofa is a sofa-bed with a mattress component. 16 CFR 1632: Cigarette Ignition Test for Upholstery
This is the standard that catches most sofa importers off guard. 16 CFR 1632 requires that the combination of fabric, foam, and any intermediate barrier materials resist ignition from a lit cigarette. The test protocol places a standard cigarette (provided by the CPSC) at five points on the upholstery assembly — the seat deck, the back, each arm, and the junction between the seat and back. The assembly passes if none of the five cigarette placements causes charring that extends more than 2.54 cm (1 inch) from the nearest point of the cigarette.
The key point for importers: this test applies to the specific combination of fabric and foam used in the production sofa, not to the fabric alone or the foam alone. If you change the fabric or the foam after testing, you need to retest. Many importers learn this when a factory substitutes a different foam density mid-production and the new combination fails the test.
Testing cost: $300 to $600 per fabric-foam combination at a CPSC-accepted laboratory. Turnaround time: 2 to 4 weeks. The test report must be kept on file for at least 3 years and produced upon CPSC request.
Lead and Heavy Metal Restrictions
The CPSIA restricts lead content in surface coatings to 90 ppm and in substrate materials to 100 ppm for children’s products. For adult residential sofas, the lead restriction applies to surface coatings only (paint, lacquer, finish on wood or metal components) at the 90 ppm limit. The CPSC enforces this through random sampling at the port of entry and through complaint-driven investigations.
For sofas with wood frames, the concern is the finish — stained or painted wood components must have a lead-in-coatings test report. For sofas with metal legs or hardware, the metal surface coating (powder coat, paint, plating) must also be tested. The National Institute of Standards and Technology provides reference methods for lead testing in coatings.
Test method: EPA Method 6200 for total lead in coatings, or XRF (X-ray fluorescence) screening followed by laboratory confirmation. Cost: $150 to $250 per component. Most factories in Foshan can provide pre-tested material certificates for their standard finishes — ask before placing the order rather than testing production units.
Labeling Requirements
Every upholstered sofa imported to the US must carry a Uniform Law Label (also called the “Do Not Remove” label) that states the filling materials. The label must include: the manufacturer or importer name and address, the state of manufacture, a description of the filling materials (e.g., “polyurethane foam,” “polyester fiber”), and the Uniform Registry Number (URN) assigned by the state regulatory authority.
The label must be permanently attached — sewn, stapled, or glued in a manner that prevents removal without leaving evidence of tampering. The label placement is typically on the underside of the seat deck or the back of the sofa. The Federal Trade Commission oversees the labeling requirements under the Textile Fiber Products Identification Act for the fabric content label, which is separate from the Uniform Law Label.
Documentation Checklist for Importers
Before your sofa shipment arrives at the US port, you should have the following documents on file. These are not submitted to customs proactively, but must be produced within 48 hours if the CPSC or CBP requests them.
1. 16 CFR 1632 test report for each fabric-foam combination used in the shipment. 2. Lead-in-coatings test report for all painted, stained, or coated components. 3. General Certificate of Conformity (GCC) for adult products, or Children’s Product Certificate (CPC) for products marketed for children’s use. 4. Uniform Law Label artwork and placement confirmation. 5. Textile fiber content label per FTC requirements. 6. Commercial invoice and packing list matching the physical shipment. 7. Test laboratory accreditation certificates (ISO 17025 for the testing lab).
